Circular 1999/4: Probationary appointments to the APS - Disallowance of amendments to the Workplace Relations Regulations

PSMPC Circular 1999/3 (paras 17-24) included advice on amendments to the Workplace Relations Regulations, specifically Regulation 30BAA, effective 18 December 1998, in respect of probationary appointments to the APS.

2. That advice noted that the new regulations were subject to parliamentary scrutiny and should a notice of disallowance be given in either House within 15 sitting days of tabling, the regulations may be disallowed.

3. In the event, the regulations, including Regulation 30BAA, were disallowed by the Senate on 16 February 1999.

4. Consequently, the regulations have effect from 18 December 1998 until 16 February 1999, after which they cease to have effect. In practical terms, this means that the regulations (including Regulation 30BAA) apply only in respect of any employee employed on or after 18 December 1998 (sub-regulation 30BAA(2)(a)) and terminated before 16 February 1999.

5. The application of the Workplace Relations Act 1996 in respect of probationers remains as set out in paras 13-16 of PSMPC Circular 1999/3.
