An employment agency has forwarded an application for an advertised vacancy – is the APS agency bound to consider it?

It is open to an individual to seek assistance from an employment agency in the drafting of their application and then submit that application as an individual or for the employment agency to submit the application on the individual’s behalf. Such an application should be considered on the same basis as any other application.

An agency is not, however, obliged to accept an application received from an employment agency unless it is satisfied that the application has been submitted on behalf of the applicant (and with the consent of the applicant) in respect of the specific duties advertised.

Unless an APS agency enters a contract with an employment agency (perhaps by requesting it to refer names of people that might be considered for the vacancy), it is generally under no obligation to pay an employment agency which forwards an application on behalf of an individual.
