Public Service Act 1922

NOTIFICATION UNDER SECTION 82AD

I, Peter Shergold, Public Service Commissioner, under paragraph 82AD(10)(a) of the Public Service Act 1922 (the Act), notify an amendment to the notification made on 19 December 1995 under that paragraph of the Act, as specified in the following schedule, with effect from the date that this notification is published in the Gazette.

Schedule to the notification

The manner in which persons shall be selected for short term employment

Insert the folloing paragraph after the first paragraph of the existing schedule to the notification:

A person who has:

  • been retired from the Service under section 76W of the Act, on or after the date that this notification is published in the Gazette, and who has received a retrenchment severance benefit calculated under clause 11.4 of the APS General Employment Conditions Award 1995; or
  • retired from the Service on or after the date that this notification is published in the Gazette, following the giving of a notice under section 76R of the Act and receipt of the specified benefit in accordance with a determination under section 82D of the Act

is ineligible to be selected for short term temporary employment within the 12 month period following the date of retirement of the person from the Service, except where the Secretary is satisfied that the short term employment of such a person is essential due to the nature of the duties to be performed and the skills, experience and/or qualifications of the person.
