The Public Service Amendment (2024 Measures No.2) Regulations 2024 amends the Australian Public Service Regulations 2023 (the Regulations) in relation to the review of promotion decisions within the Australian Public Service.
The changes commence on 1 April 2025 and amend the framework within which the Merit Protection Commissioner (MPC) undertakes promotion reviews, including by ensuring reviews consider whether the entire selection process was merit-based.
The changes also create ‘own motion’ powers for the MPC to enable audit and investigation of agencies’ hiring practices, as well as including definitions of the terms ‘merit pool’, ‘ranked merit list’ and ‘ranked merit pool’ into the Regulations (as a consequence of the amendments made to promotion reviews).
